Random question !
My child’s other parent and I agree about parenting time. Do we need to get a court order?

I have a court order granting parenting time to my child's other parent but that parent refuses to exercise this time, is there anything I can do?

First off there is no true legal remedy for this situation. The court cannot force a person to exercise visitation. This leaves you with few options, yet there are a few depending upon how you would like to persue the matter. Just remember to always document your efforts and keep date specific records of all attempts made to involve the other parent.

You could first try reasoning with the other parent. Alot of times people will fail in this obligation out of hurt and grief. While some others will attempt to do to punish the other parent. Sometimes by sitting down with a person things can be worked out and the true reasons for this failure can be resolved. If it is a high conflict situation use of a mediator is recomended.

The next thing you could do if reasoning has failed is to file a comlaint with your local FOC. Granted nothing much may come of this, but some will play brinksmanship and a trip to FOC could resolve the situation.

If both of the options above fail and if you kept the detailed records as indicated above you could petition for the reduction of the parenting time. While this will not resolve the issue, it leaves you with a couple less problems. Like explaining to the kids why somebody failed to show up and the last second change in your own schedule because of the failure to appear.
